Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Mimir (the “Service”), provided by CajeFX (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service
We provide Mimir as an online software service. Features, limits, and availability may change over time. We may suspend or discontinue parts of the Service for maintenance, security, legal compliance, or business reasons, with reasonable effort to minimize disruption where practicable.
3. Accounts and access
You are responsible for safeguarding login credentials and for activity under your account. Notify your administrator or us promptly if you suspect unauthorized access. We may disable accounts or access that violate these Terms or pose a security risk.
4. Acceptable use
You agree not to:
- Violate applicable laws or third-party rights
- Probe, scan, or test the vulnerability of the Service without authorization
- Interfere with or disrupt the Service or other users’ use of it
- Upload or transmit malware, unlawful content, or content you do not have rights to use
- Attempt to gain unauthorized access to systems, data, or accounts
- Reverse engineer the Service except where applicable law prohibits this restriction
Your organization’s administrator may impose additional acceptable-use rules.
5. Customer data and privacy
Processing of personal information is described in our Privacy Policy (see the in-app link). You are responsible for the legality and accuracy of data you or your organization submits to the Service.
6. Intellectual property
We and our licensors retain all rights in the Service, including software, branding, and documentation. Subject to these Terms and your agreement with us (or your organization’s agreement), we grant you a limited, non-exclusive, non-transferable right to use the Service during the subscription or access period.
7. Third-party services
The Service may integrate with third-party products (for example, identity, email, or storage). Those services are governed by their own terms and privacy notices.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CAJEFX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100), IF NO FEES APPLIED.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
10. Indemnity
You will defend and indemnify CajeFX against claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, or your violation of these Terms or applicable law, except to the extent caused by our misconduct.
11. Changes
We may modify these Terms by posting updated terms in the app or notifying your organization. Continued use after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
12. Termination
We may suspend or terminate access to the Service for breach of these Terms or for other good cause. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.
13. Governing law
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, excluding conflict-of-law rules. Courts located in Manitoba have exclusive jurisdiction, subject to mandatory consumer protections where applicable.
